The FCC proposed a $280,000 fine against retailer Best Buy for not properly warning their patrons of the upcoming digital TV conversion when selling them analog sets. According to a labeling rule the group established, any analog set currently sold should come with a warning that the device being purchased may not work after February 17, 2009. Best Buy, Circuit City, and Sears have all received “proposed fines” for not following the rule. Each retailer is challenging the fines, however, Best Buy has been the most vocal. “The Commission has not claimed any express authorization from Congress to enact the Labeling Rule, and none exists,” Best Buy said in a 41 page response.
