Konami released an arcade game in Japan called GuitarFreaks which is apparently similar to Guitar Hero/Rock Band several years ago. They patented their controllers, of course, which led to their decision to sue. One wonders why they’ve waited so long to take action against the company if they felt so strongly violated. Thought Comcast throttling your Bit Torrent was bad? Now the MPAA wants to keep your DVRs from being able to record certain films. The odd thing is, DVRs can only record and save programming on broadcast television, not Pay Per View.

Two professors and a student at the University of Washington have released a study called Why My Printer Received a DMCA Takedown Notice. As part of their research, they monitored BitTorrent networks using a specific client to monitor traffic. Nothing was uploaded, nor was it download, but, they received over 400 takedown requests accusing them of piracy. Harry Potter author J.K. Rowling has filed a lawsuit against the makers of the London Star Map. As you can tell from the name, the map in question contains home addresses of many notable London-based celebrities, including Rowling. Rowling was quoted as saying, “The sole aim of London Star Map is self-evidently to incite, encourage and enable members of the public to track down and locate the exact location of private residences of various recognisable ‘celebrities’ so that they can visit those residences.” Most will remember her recent suit against a 50-year old librarian over his attempts to have his un-authorized Harry Potter encyclopedia published. A few weeks back Yoko Ono filed a lawsuit against the producers of Ben Stein’s creationist documentary Expelled. Ono was steamed over the unauthorized use of John Lennon’s Imagine in the film. The producers felt that since they only used 15-seconds of the song fell within their fair use rights. U.S. District Judge Sidney Stein agreed and ruled in their favor, which, of course, didn’t sit well with Ono. Her lawyers have yet to release an official response. Kathleen Firrantello, daughter of late jazz musician Joe Farrell, has filed a lawsuit against Kanye West, Method Man, Redman, Common and their respective record companies over unauthorized sampling of her father’s work. The suit states that elements of Farrell’s Upon the Rock were used in West’s “Gone,” Common’s “Chi-City,” and Method Man and Redman’s “Run 4 Cover.” Firrantello is seeking at least $1 million in damages and that the song be pulled from the digital and brick-and-mortar retailers. The FCC proposed a $280,000 fine against retailer Best Buy for not properly warning their patrons of the upcoming digital TV conversion when selling them analog sets. According to a labeling rule the group established, any analog set currently sold should come with a warning that the device being purchased may not work after February 17, 2009. Best Buy, Circuit City, and Sears have all received “proposed fines” for not following the rule. Each retailer is challenging the fines, however, Best Buy has been the most vocal. “The Commission has not claimed any express authorization from Congress to enact the Labeling Rule, and none exists,” Best Buy said in a 41 page response. Konami has filed suit against Harmonix, MTV Networks, and Viacom for allegedly violating patents with Rock Band’s guitar peripheral. According to Joystiq, Konami is seeking both monetary compensation and a block on future use of the aforementioned peripherals. No statement has been released from the other side.
